1. Acceptance and Scope

These Terms of Use constitute a legally binding agreement between you and quisaliventa (ABN pending, operating from Shop 8, Style Arcade, 14-16 Franklin St, Griffith ACT 2603, Australia). Your continued use of our platform indicates your acceptance of these terms and any future modifications.

Our educational platform provides financial literacy content, business management guidance, and related resources. These terms apply to all users, whether you're browsing freely available content or participating in structured learning programs.

2. User Obligations and Conduct

Account Responsibilities

When you create an account with quisaliventa, you're responsible for maintaining the security of your login credentials. Don't share your password with others or allow anyone else to access your account. You agree to notify us immediately if you suspect unauthorized access.

All information you provide during registration must be accurate and current. If your contact details or other account information changes, update it promptly through your account settings.

Acceptable Use

Our platform exists to help people build genuine financial knowledge and business skills. You agree to use our services only for lawful purposes and in ways that don't harm others or interfere with their use of the platform.

• Don't attempt to access areas of the platform you're not authorized to view, or try to circumvent security measures or access restrictions we've put in place.
• Don't use automated tools like bots or scrapers to collect data from our platform without explicit written permission from us.
• Don't upload or transmit viruses, malware, or any code designed to disrupt or damage systems or data.
• Don't impersonate other users, quisaliventa staff, or any other person or entity when using our services.
• Don't use our platform to distribute spam, unsolicited messages, or promotional content without authorization.

3. Educational Content and Services

Nature of Our Services

quisaliventa provides educational content about financial management, business operations, and related topics. Our courses, articles, and resources aim to build understanding and skills that may support your professional or personal financial decisions.

Content Accuracy and Updates

We work to keep our educational content current and accurate, but financial regulations, business practices, and market conditions change. Information that was accurate when published might become outdated. We can't guarantee that every piece of content reflects the latest developments.

Some of our educational programs run on specific schedules. Enrollment for autumn 2025 programs typically opens several months in advance. Check our Learning Program page for current scheduling and availability.

No Outcome Guarantees

Learning financial concepts and business skills can be valuable, but we don't promise specific results from using our educational resources. Your success depends on many factors outside our control, including your effort, existing knowledge, market conditions, and how you apply what you learn.

4. Intellectual Property Rights

Our Content Ownership

All content on the quisaliventa platform including text, images, videos, course materials, software, and design elements is owned by quisaliventa or our content licensors. This content is protected by Australian and international copyright, trademark, and other intellectual property laws.

Your Limited License

When you access our educational content, we grant you a limited, non-exclusive, non-transferable license to view and use that content for your personal educational purposes. This means you can:

• Access and view course materials as part of your enrollment
• Download resources we specifically make available for download
• Take notes and create summaries for your own learning

You can't redistribute, sell, or commercially use our content without written permission. Don't copy entire courses or substantial portions of our materials to share with others or post publicly.

User Submissions

If you submit content to quisaliventa such as comments, forum posts, questions, or project work, you retain ownership of that content. However, you grant us a worldwide, royalty-free license to use, display, and distribute your submissions in connection with operating and improving our educational platform.

Don't submit anything you don't have the right to share, or content that infringes someone else's intellectual property rights.

5. Payment Terms and Refunds

Program Fees

Some educational programs require payment. All fees are displayed in Australian dollars (AUD) and include GST where applicable. Prices may change, but any changes won't affect programs you've already enrolled in and paid for.

Payment is due at the time of enrollment unless we've arranged a different payment schedule with you. We accept major credit cards and other payment methods as indicated during checkout.

Refund Policy

We want you to feel confident in your decision to learn with quisaliventa. If a paid program doesn't meet your expectations, you may request a refund within 14 days of enrollment, provided you haven't accessed more than 25% of the course content.

Refund requests should be sent to help@quisaliventa.com with your enrollment details and reason for the request. We'll process approved refunds within 10 business days. Some payment processing fees may not be refundable.

After the 14-day period or once you've accessed more than 25% of content, enrollment fees are non-refundable. We encourage you to review program descriptions carefully before enrolling.

6. Privacy and Data Usage

Your privacy matters to us. We collect and use personal information as described in our Privacy Policy, which forms part of these terms. By using quisaliventa, you consent to our data practices as outlined in that policy.

Information We Collect

We gather information you provide directly, like your name, email, and payment details when you create an account or enroll in programs. We also collect usage data about how you interact with our platform to understand learning patterns and improve our services.

How We Use Your Data

We use your information to deliver educational services, communicate with you about your account and programs, improve our content and platform, and comply with legal obligations. We don't sell your personal information to third parties.

We may share aggregated, non-identifying data about platform usage for research or marketing purposes. This data can't be traced back to individual users.

7. Account Termination

Your Right to Close Your Account

You can close your quisaliventa account anytime by contacting us at help@quisaliventa.com. Closing your account will terminate your access to paid programs and services, subject to our refund policy outlined above.

Our Right to Suspend or Terminate

We may suspend or terminate your access to quisaliventa if you violate these terms, engage in fraudulent activity, or use our services in ways that harm other users or our platform. We'll typically provide notice before termination unless the situation requires immediate action.

If we terminate your account for terms violations, you won't be entitled to refunds for any unused portion of paid programs.

8. Disclaimers and Limitations

Service Availability

We work to keep quisaliventa accessible and functional, but we can't guarantee uninterrupted service. Maintenance, technical issues, or circumstances beyond our control may occasionally affect platform availability. We're not liable for losses resulting from service interruptions.

Limitation of Liability

To the maximum extent permitted by Australian law, quisaliventa and its directors, employees, and agents won't be liable for indirect, incidental, consequential, or punitive damages arising from your use of our services. This includes loss of profits, data, business opportunities, or other intangible losses.

Our total liability for any claims related to our services is limited to the amount you've paid to quisaliventa in the twelve months preceding the claim, or $100 AUD, whichever is greater.

Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any consumer rights you have under the Australian Consumer Law or other applicable legislation that can't be excluded, restricted, or modified by agreement.

9. Third-Party Links and Services

Our platform may include links to external websites, tools, or resources operated by third parties. These links are provided for convenience and don't imply endorsement. We're not responsible for the content, privacy practices, or availability of external sites.

Some features may integrate with third-party services like payment processors or analytics tools. Your use of these services may be subject to their own terms and policies. Review those terms before using integrated third-party services.

10. Changes to These Terms

We may update these Terms of Use periodically to reflect changes in our services, legal requirements, or business practices. When we make significant changes, we'll notify you by email or through a prominent notice on our platform.

The updated terms will take effect 14 days after we post them, or when you next use our services after the changes, whichever comes first. Your continued use of quisaliventa after changes take effect means you accept the modified terms.

If you don't agree with changes to these terms, you should stop using our services and may close your account as described in section 7.

11. Dispute Resolution

Governing Law

These terms are governed by the laws of the Australian Capital Territory and the Commonwealth of Australia. You and quisaliventa both agree to submit to the non-exclusive jurisdiction of courts in the Australian Capital Territory for resolving disputes.

Informal Resolution

Before pursuing formal legal action, we encourage you to contact us directly to resolve any concerns. Many issues can be addressed through discussion. Reach us at help@quisaliventa.com with details about your concern.

We'll work in good faith to resolve disputes informally within 30 days of receiving your notice. If we can't reach a resolution, either party may pursue formal dispute resolution.

12. General Provisions

Entire Agreement

These Terms of Use, together with our Privacy Policy and any additional terms specific to particular services, constitute the entire agreement between you and quisaliventa regarding your use of our platform.

Severability

If any provision of these terms is found unenforceable or invalid by a court, that provision will be modified to the minimum extent necessary to make it enforceable, or removed if modification isn't possible. The remaining provisions continue in full effect.

No Waiver

Our failure to enforce any right or provision in these terms doesn't constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized quisaliventa representative.

Assignment

You can't transfer or assign your rights or obligations under these terms without our written consent. We may assign these terms or transfer our rights to another entity in connection with a merger, acquisition, or sale of assets, with notice to you.
